Notary Witness
A notary witness is a notary public who serves as a third party witness to a private administrative process. For example, if you send a Notice to someone who has not performed as they should (owes you money, services or whatever) and you list the notary's name and address as a public official to whom they can send their answer, it does not preclude the Respondent from answering directly to you, but your document should direct replies to you care of the notary's address so a record can be kept. You will be notified of any responses received. If no reply comes through, or if a reply is received that does not address the questions asked, the notary will then prepare a Notice of Non-Response and send it to you. If you cannot locate a notary in your area who is willing to be a witness for your process, we have notaries who can help. Your local notary can acknowledge your signature but the witnessing notary can be located anywhere. If an answer is not received within the time specified in your document, contact us or the notary to verify that s/he has not gotten a response either. We offer 2 ways in which you can utilize a Notary Witness: 1) A Presentment: the Document or Instrument that is served to the Respondent(s). If it is not replied to or acted upon, the notary can issue a Affidavit of Non-Response. You would send us the completed paperwork which notes how many days they have to respond, and the notary's name and address (use the contact form below to ask us for that information) for the party(ies) to respond to. The notary serves the document to the Respondent(s) along with a "Notary Presentment" and a "Proof of Service and Witness of Contents" document. If the alotted time passes with no reply, send us an e-mail and an Affidavit of Non-Response will be issued. The suggested donation for one (1) serving and a Notice of Non-Response if needed, would be $75.* You can make this into a multi-step process if you want the notary to issue a Verified Notice of Fault and then a Default/Dishonor which would be an additional $75, for a total of $150. OR 2) If you want a formal Certificate of Dishonor for a process you had previously completed, please see our Certificate of Dishonor Method / Notary Protest page. *If there is more than one Respondent and they are at different addresses, please include $10 per each additional party for each mailing to cover the extra expenses . If there are multiple parties at the one address, add an extra $5 or $10 to cover copying & postage. Rather than get into 'nickel & dime' details here, we'll leave the additional funds to your discretion based upon how many pages your documents are, how many parties, etc. Use the form below or e-mail us if you have a question. Respondents are in other countries or many documents
to present, that would drive up the cost, so consider
the prices mentioned to be guides. Your particular
process may not fit the 'model'.
